Toowoomba Regional will face court over its rejection of an application to build a childcare centre at one of Toowoomba’s most dangerous locations.

The notorious James Street site – corner of Warrego Highway – has seen numerous trucks roll or crash, which helped lead council to vote 6-5 against the proposal, even though its own planners recommended the application for approval.

The developers’ lawyers for the childcare centre have lodged an appeal against the council's decision in the Planning and Environment Court in Brisbane, they are seeking the original decision be set aside and the development approved with reasonable and relevant conditions.
