Banana Boat Sunscreen Could Face A Consumer Class Action

A class action could be brought against Banana Boat sunscreen after numerous customers allege they received burns while using aerosol products from the brand.

Bannister Law are inviting consumers who may have been impacted to come forward as they investigate a potential class action against the makers of Banana Boat sunscreen, Edgewell Personal Care Australia.

“Allegedly, Banana Boat Aerosol products within this range were labelled, marketed and advertised as having a higher SPF level than they actually were within Australian standard,” they said.

The ABC reports Bannister Law has also asked skincare product-testing company Eurofins Dermatest to conduct independent tests on seven Banana Boat aerosol sunscreens.

These products are Banana Boat Kids Clear Sunscreen Spray SPF 50+, Banana Boat Ultra Clear Sunscreen Spray SPF 50+, Banana Boat Sport Clear Sunscreen Spray SPF 50+, Banana Boat Everyday Clear Sunscreen Spray SPF 50+, Banana Boat SunComfort Clear Sunscreen Spray SPF 50+, Banana Boat Dry Balance Clear Sunscreen Spray SPF 50+, Banana Boat Sport Coolzone Clear Sunscreen Spray SPF 50+.

Principal of Bannister Law Charles Bannister said consumers who bought Banana Boat aerosol sunscreens could mount a legal case against the company.

"We'd like a full refund for all consumers who have purchased and been misled by the packaging," he said.

An Edgewell Personal Care Australia spokesperson has disputed and questioned the SPF results provided by Dermatest.

“These results are entirely inconsistent with the testing we have conducted at Edgewell’s reputable labs in accordance with the Australian mandatory standard as regulated by the TGA. All Banana Boat products meet the SPF claim as labelled on pack,” they told Triple M.

“To further support this the TGA has recently undertaken independent testing, which included Banana Boat Ultra Very High Protection Clear Spray SPF50+ sunscreen, and found that all products tested contained the correct levels of active ingredients as specified on their labelling and complied with the Australian regulatory guidelines for sunscreens. 

“At Banana Boat our number one priority is providing effective sun protection for Australian consumers."
