One of the four men arrested over a terrorist plot to blow up a plane out of Sydney has been released without charge.

The 50-year-old man was released from police custody overnight while the other THREE remain behind bars.

Time is now running out for Federal Police to lay charges after a Magistrate granted them a seven-day extension last Sunday to investigate the plot and interrogate the men allegedly involved.

His lawyer also hitting twitter saying he'll look into the police actions.

This is a joint release between the Australian Federal Police and NSW Police

"Four men were arrested by the NSW Joint Counter Terrorism Team on Saturday, 29 July, regarding an investigation into allegations that some people were intending to commit a terrorist attack using an improvised device.

One of those men – who is 50 years old – was released from police custody last night (Tuesday, 1 August) without being charged with a criminal offence.

Three men remain in detention under 'specified time' provisions outlined in Section 23DD of the Crimes Act 1914 (Cth).

This investigation remains ongoing, and further information will be provided at an appropriate time."
