The developers of a proposed two-storey health service in East Toowoomba will take Toowoomba Regional Council to court.
The disagreement between TRC and developer Allied Health Partners is over the re-routing of a sewer main as the Scott Street address.
Allied Health Partners lodged an appeal against the condition of its approval from the TRC in the Planning and Environment Court.
CONDITION:
‘A sewer main running under the proposed facility needs to be re-routed along the Scott St footpath, at no cost to the council.’
Allied Health Partners told the council the condition was not fair or reasonable - the condition will put an unreasonable cost imposition on the development.
