Fast food juggernaut McDonald's are bringing out the big legal guns, having slapped a "cease and desist" on a burger restaurant in western Sydney.

Burger Head in Penrith posted a photo of the letter from lawyers acting for the corporation, which was sent in response to a Facebook post promoting their latest burger.

"You've seen the @McDonaldsAU bring out their bigger better Big Mac, the Grand Mac," the original post read. "Here's our take on things: Better Mac."

The burger was on special from January 13 through til 25, although the original post has since been deleted.

But, Burger Head confirmed, that move put them firmly in the "McSh*t".

"The burger will now be referred to as The Whopper," they wrote on Facebook alongside a copy of the letter.

A spokesperson for McDonald's told 7News that it was "simply a marketing ploy to leverage our well-established and iconic brand" and that "the name and promotion are infringing on our trademark by clearly mirroring our famous Big Mac".

It seems Burger Head aren't too intimidated by McDonald's power play; they've now re-branded the same burger as the Cease and Desist, which will be available until Feb 2.
